Privacy Notice

This Privacy Notice explains how Koçsoft Teknolojik Yazılımlar ve Danışmanlık Ticaret Limited Şirketi (“MAGEN”), as the data controller, processes the personal data you share through the contact and quote forms on magensystems.com. It has been prepared under Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”).

2. Personal Data We Process

When you fill in a form on our website, we process the following personal data:

• Identity: your full name,
• Contact details: your phone number and e-mail address,
• Request details: the product or service you are interested in and the information you include in your message,
• Transaction data: the address of the page from which you submitted the form.

Please do not include in the message field any personal data that is not needed for your request, or any special categories of personal data (such as health, religion or ethnic origin).

3. Purposes of Processing

• Responding to your information, demo and quote requests,
• Preparing and sending quotes for the products and services you request,
• Contacting you by phone or e-mail about your request.

4. Collection Method and Legal Grounds

Your personal data is collected electronically and directly from you when you fill in the contact and quote forms on our website. It is processed on the following legal grounds:

• Article 5(2)(c) KVKK: processing is necessary for the establishment or performance of a contract, provided that it is directly related to that contract (preparing quotes and pre-contract discussions),
• Article 5(2)(f) KVKK: processing is necessary for the legitimate interests of the data controller, provided that it does not harm your fundamental rights and freedoms (responding to your requests and communicating with you).

By ticking the consent box on the form, you give your explicit consent (Article 5(1) KVKK) to the processing of your data as described in this notice, including the transfer to service providers abroad described in Section 5. You may withdraw your consent at any time by writing to [email protected]; withdrawal does not affect the lawfulness of processing carried out before it.

5. Transfers of Personal Data

The information you submit through a form is delivered to the MAGEN team by e-mail. Website hosting, form infrastructure and e-mail service providers are used for this delivery and storage, and their servers may be located outside Türkiye. In that case, your personal data may be transferred abroad in accordance with the conditions set out in Article 9 of the KVKK.

Apart from this, your personal data is not shared with third parties, except with public authorities that are legally entitled to request it, and only to the extent required by law.

6. Retention

We keep your personal data until your request has been concluded and for a reasonable period afterwards for follow-up questions, quote updates or legal obligations. At the end of this period, the data is deleted, destroyed or anonymized.

7. Your Rights under Article 11 of the KVKK

By applying to the data controller, you have the right to:

• learn whether your personal data is being processed,
• request information about the processing if your data has been processed,
• learn the purpose of the processing and whether your data is used in line with that purpose,
• know the third parties in Türkiye or abroad to whom your personal data has been transferred,
• request the correction of incomplete or inaccurate personal data,
• request the deletion or destruction of your personal data under the conditions set out in Article 7 of the KVKK,
• request that any correction, deletion or destruction be notified to the third parties to whom your personal data has been transferred,
• object to a result against you that arises from the analysis of your data exclusively by automated systems,
• claim compensation for damage you suffer as a result of the unlawful processing of your personal data.

8. How to Apply

You can send requests regarding your rights to [email protected], together with information that allows us to verify your identity (your full name and the contact details you used on the form). We will conclude your request as soon as possible and within thirty days at the latest, free of charge; if the action requires an additional cost, a fee may be charged according to the tariff set by the Turkish Personal Data Protection Board.
